Terms of use

 

Chapter 1. General Terms

  1. I-Trade Inc (hereinafter referred to as "Company") hereby establishes the following terms of use (hereinafter referred to as "TOU") for persons (hereinafter referred to as "user") who utilizes the company's website.

  2. By accessing or using the company website, you are also deemed to have read and agreed to the company's Privacy Policy and Cookies Policy and to have accepted any further upgrade, modification, addition or change to the TOU.

  3. Company reserves the right to update the TOU at any time without notice to user.

  4. This Agreement shall be governed by the laws of Japanese Jurisdiction only, and without regard to its conflict with any other provisions of law.

 

Chapter 2. Limitation of Liability

  1. Company offers no guarantees as to validity, accuracy, correctness or reliability of any information on the website or regarding goods and services provided, except where any warranty is expressly stated herein.

  2. Company handles its goods with care, however due to nature of used cars (hereinafter referred to as "goods"), all sales are based on "as is" condition with no exceptions. The company bears no liability for defects, problems or the general condition of goods.

  3.  Company bears no liability for any document, agreement or contract unless it is an original document stamped with the official company seal.

  4. Company will not accept the return of any goods provided under any circumstances.

 

Chapter 3. Service Eligibility

For service eligibility, you must confirm:

  1. You have reached the age of civil majority;

  2. You will have only one I-Trade Inc Account, using a valid email address with no false information.

  3. All information provided is accurate to the best of your knowledge.

 

Chapter 4. Order

  1. Company only accepts orders through its website. It is the user's responsibility to check and confirm any specifications of the goods (year of manufacture, type of fuel, transmission etc).

  2. Company reserves the right to cancel any fraudulent/incomplete order without any prior written or verbal notice.

  3. User will be required to pay a deposit (prepayment) before any orders can be accepted by company. This deposit will amount to 25%" of the user's target price but not less than 1,000 USD (100,000 JPY) and will be held by company as security until any balance is cleared. In cases where the balance is not cleared, the deposit will be withheld by company

 

Chapter 5. Shipping

  1. Shipping is conducted after confirmation of full payment of 100% by user.

  2. It is the user's responsibility to verify and follow any and all laws or regulations pertaining to import, customs, taxation or any other relevant areas in their country of business and, where it differs, in the destination country/countries for the goods.

  3. Company may not be held liable for losses arising from a failure to meet import, custom or tax regulations of any relevant country.

  4. Company may not be held liable for any losses that result from changes made to the shipping schedule or cost by the shipping company.

  5. Company reserves the right to change, postpone or cancel the shipping if there is any balance left unpaid.

  6. Release of vehicle from port of discharge, custom clearance and vehicle registration are the sole responsibility of the user.

 

Chapter 6. Risk and Title

  1. Any risks pertaining to the goods shall be deemed to be the user's liability at the point that the goods pass the rail of the ocean-going vessel at the port of loading.

  2. Company shall reserve the title to the goods until the full payment for goods is received by company.

 

Chapter 7. Storage fees

  1. For most of shipping ports of Japan, we provide free storage for 45 days. (for some ports, free storage is 7~30 days)

  2. In any cases where shipping is delayed due to any of the following reasons, the user is liable for storage fees at the rate of 5$ (500 JPY) for passenger cars (1 unit per 1 day); and  20$ (2,000 JPY) for truck/buses (1 unit per 1 day) starting from the 31st day of storage.

  • delay of payment (payment was not received within 7 days)

  • specific requests for shipping from user

  •  any request from user that result in delay of shipment

 

Chapter 8. Cancellation by user

  1.  Cancellation before shipping: User may cancel the order before the goods are shipped and will be required to pay a cancellation fee as detailed below.

*In some circumstances (specific vehicles, vehicles older than 15 years, trucks, buses, construction equipment etc), we reserve the right to collect a cancellation fee of up to 100% of the total price.

 

2. Cancellation after shipping: User may cancel the order after the goods have been shipped and will be required to pay a cancellation fee as detailed below.

Chapter 9. Cancellation by company

  1. Company reserves the right to cancel any orders and to collect any applicable cancellation fees from any amounts previously received from the user in cases where payment is not received within 14 days. (as detailed below)

  2. In some circumstances (specific vehicles, vehicles older than 15 years, trucks, buses, construction equipment etc), we reserve the right to collect a cancellation fee of up to 100% of the total price.​

Chapter 10. Damages and losses

  1. Company makes no guarantees whatsoever for the completeness, accuracy, usability, etc., of any and all information, up to and including the description of the service, the user may receive whilst using the service.

  2. Company is not liable for any disputes between the user and third parties that may arise through the use of our service.

  3. In addition to the above, user is liable for any damages incurred by company as a result of user's violation of TOU, criminal intent, or gross negligence.

  4. Any rights or obligations hereunder shall not be assigned or delegated by either party without the prior written consent of the other party. In the event an assignment is consented to by the other party, this TOU shall inure to the benefit of and be binding upon the successor or the assignee

 

Chapter 11. Privacy Policy and Cookie Policy

All information obtained through the course of business contains value, and I-Trade Inc understands that you care how your personal information is shared and used.

Please, read Company's Privacy Policy and Cookie Policy carefully to understand what types of information we gather from our platforms and third-parties, including how these data are processed and used.

 

Chapter 12. Minors

Company do not sell vehicles or any products for purchase by children. Minors may use i-tradeinc.com only with adult supervision. We do not knowingly gather personal information from children under the legal age of majority according to each specific country we deal with.

 

Chapter 13. Disputes

  1. Should any disputes between company and user arise with regard to goods or services, the parties concerned agree to attempt to settle any such disputes in a sincere manner through discussion.

  2. If the dispute cannot be resolved through discussion between the parties concerned, the Tokyo District Court holds original and exclusive jurisdiction over the dispute.

 

Chapter 14. RESTRICTED COUNTRIES/REGIONS

Company does not sell, or accept payments, or make payments to the countries/regions that are under sanctions: North Korea, Iran, Cuba, Syria, Crimea, Sanctioned Russian Parties, Government of Venezuela, Any Other Sanctioned Target
